Are MDMA therapy sessions still legal and possible in the Netherlands after the ban on analogues in 2025?

Although the supply of legal MDMA analogues has been officially banned since July 1, 2025, remains MDMA-assisted therapy possible in the Netherlands in a manner whereby the client brings the substance themselves in a limited quantity. This approach is justified under 'personal responsibility' and falls within the limits of what is legally permitted.

  • Since July 1, 2025 It is prohibited to offer MDMA analogues within the sessions — the legal scope for doing so has lapsed.
  • Nevertheless, MDMA sessions remain possible based on a structure aimed at harm reduction. This means that clients a bring a limited amount of MDMA or an analogue yourself, and use this for personal consumption during the sessions
  • The conditions:
    1. Personal responsibility for the substance: It is tolerated to do it yourself (maximum 500 mg) to take along, which is considered by the Public Prosecution Service as a 'small quantity for personal use'.

    2. The therapeutic session is a form of coaching and does not involve BIG-regulated actions or the claiming of medical treatment. This makes it legal in terms of healthcare legislation.
