Psilocybine is in Nederland niet legaal verkrijgbaar. De verkoop, het bezit en het gebruik ervan zijn verboden. Er zijn wel een paar uitzonderingen: * **Paddo's in smartshops:** Hoewel paddo's met een hoog psilocybinegehalte illegaal zijn, worden er in sommige smartshops nog steeds varianten verkocht die een lager gehalte psilocybine bevatten. De legaliteit hiervan is echter een grijs gebied en de politie kan hiertegen optreden. * **Psilocybine-kweeksets:** Ook kweeksets voor paddo's zijn illegaal, al kun je ze soms online vinden. Het produceren van psilocybine is verboden. * **Medisch gebruik (beperkt):** In het kader van wetenschappelijk onderzoek of een medische behandeling onder strikte voorwaarden kan psilocybine soms onder toezicht worden toegediend. Dit is echter niet voor algemeen gebruik beschikbaar. Het is belangrijk om te weten dat het gebruik van psilocybine risico's met zich meebrengt.

Psilocybin is an illegal substance in the Netherlands and may only be used with government permission in the context of scientific research. Therefore, you cannot simply be in possession of isolated psilocybin. A legal way to still make use of psilocybin is to use magic truffles; these also contain psilocybin and are legally permitted to possess.
At Triptherapie, we therefore use magic truffles, which contain psilocybin as psilocin, the active compounds responsible for the psychedelic effects. In the Netherlands, therefore, you can undergo psilocybin therapy because there are legal alternatives.

@corrybach The magic mushroom grow kits you can buy are legal as long as no mushrooms are growing on them. As soon as magic mushrooms appear, you are officially not allowed to possess, sell, or trade them. However, using them is not punished.

If you isolate a small amount of psilocybin for your own use, you will face prosecution. Just as with MDMA, you are allowed to possess 500mg without serious consequences. But you must certainly not distribute it.

In the Netherlands, you can currently get three ways to psilocybin:
1. Magic truffles (100% – legal)
This is by far the easiest way. Truffles contain the same active ingredients (psilocybin and psilocin) as magic mushrooms, but aren’t themselves covered by the Opium Act. You can simply buy them in smart shops or online. They’re available in various strengths, so you decide for yourself how deep you want to go.
2. Paddock kits (grey area)
The kits themselves are legally available for purchase, but as soon as mushrooms actually grow from them, possession is technically illegal. In practice, personal use is not prosecuted, but trading or selling them is risky.
3. Isolated psilocybin (illegal)
Powder, capsules or extracts are covered by the Opium Act. As Bopo has already pointed out: you are unlikely to face prosecution for small quantities for personal use, but as soon as you start sharing or selling them, it is actively punishable.
Scientific research
With a special licence, isolated psilocybin can be used legally for research purposes, but this is obviously not for personal use.
