The future of the legality of MDMA analogues and associated therapies is currently uncertain and depends on various factors, including political decisions and legislative processes. The government has meanwhile attempted to ban MDMA analogues with a new law. This law was not passed by the Senate because there was an error in the House of Representatives' bill; it would have inadvertently banned many substances that were not intended (such as aspartame). The law must now be revised by the House of Representatives before it can be voted on again.

Currently, Dutch legislation still permits the use of MDMA analogues that are not explicitly listed in the Opium Act. This provides a legal basis for offering therapies with these substances. However, if the government decides to submit and approve the new analogues bill, this could change the situation. We expect it will take until summer 2025 before a new decision is made.

As of July 1, 2025, many analogues of MDMA will become illegal. After this, there will still be opportunities to facilitate sessions that closely resemble MDMA. More on this will follow.
